Starting with the groundbreaking Cranston, Rhode Island wastewater concession P3 project, Hawkins has developed an extensive national practice in the wastewater sector. Our work as owner’s lead counsel includes procurements and contracts for over 45 major wastewater projects. These include new wastewater treatment facilities; major upgrades, expansions and replacements of existing wastewater treatment plants; combined sewer overflow facilities; and long term operating contracts for wastewater plants coupled with capital improvements. We have successfully completed wastewater treatment projects using all forms of competitive proposal-based alternative project delivery methods. Our water project attorneys have in-depth familiarity with negotiating and allocating the risks inherent in contracting for upgrades of existing wastewater plants such as plant condition risk and the risk of upgrading existing operating facilities to meet more stringent regulatory standards.
